By visiting, registering, accepting an offer, or using any services or digital content on proplay-academy.com (referred to as “the Platform”), you (also referred to as “User” or “you”) confirm that you’ve read, understood, and agreed to these General Terms and Conditions (“General Terms”). By doing so, you agree to follow these rules legally.
If you don’t agree to the General Terms, please stop using the Platform right away.
You confirm that you are of legal age in your country or region. If you’re under the legal age but at least 13 years old, a parent or legal guardian must agree to these terms on your behalf. By registering, you confirm that this consent has been given. If you’re under 13, you cannot use the Platform.
By registering, you also confirm that you meet all of these requirements. If not, you must not use the Platform.
1. Definitions
- Platform – the website available at https://proplay-academy.com.
- User – anyone using the Platform and its features.
- Customer – a User who accepts an offer and purchases services or digital content. Customers are also bound by separate Terms of Service.
- Coach – experienced players who provide coaching and support through the Platform. Coaches do not post their own services or prices; everything is handled by us.
- Services – in-game help provided to Customers, like coaching, strategy sessions, or challenge assistance.
- Price – the cost of any Services on the Platform.
- Offer – a proposal to provide Services.
- Order – an accepted Offer.
- Warranty period – a set time after the Order during which the Customer can ask for corrections or partial refunds if something isn’t right.
2. About These Terms
2.1 These General Terms, along with our Customer and Coach Terms of Service (if they apply to you), form the full agreement between you and us.
2.2 By using the Platform or registering, you agree to all of the terms.
2.3 This agreement replaces any older discussions or agreements, whether written or spoken.
2.4 The terms describe how you are allowed to use the Platform and define the relationship between you and Game Gambit Ltd (“we,” “us,” or “our”).
2.5 The Platform is owned and operated by ProPlay Academy.
2.6 You are given a license to use the Platform. You do not own it or any of its parts.
2.7 We may suspend your access if you break the rules or any applicable law.
3. Using the Platform
3.1 The Platform lets Customers get in-game help from skilled Coaches. This includes:
- Listing Offers created by us
- Allowing interaction between Customers and Coaches
3.2 Offers are created based on what Users usually request.
3.3 Services are provided by Coaches under our control and management.
3.4 We give Users a non-exclusive license to use the Platform’s features.
3.5 All communication between Customer and Coach is managed by us.
3.6 You’re responsible for any costs you incur while using the Platform.
3.7 We do not guarantee that the Platform is legal or appropriate in all locations. You’re responsible for following local laws.
3.8 You must follow our Privacy Policy and Cookie Policy.
3.9 You must not:
- Try to harm the Platform with malware or hacking
- Try to access areas you’re not authorized to
3.10 We may suspend access to the Platform at any time.
4. Registration and Account Security
4.1 You may need to register to use the Platform.
4.2 Do not share your game account with anyone else.
4.3 Keep your login details private. Let us know if someone else accesses your account without permission.
4.4 Provide accurate and truthful information during registration and keep it updated. If we suspect false info, we may remove or block your account.
4.5 We may access information and communications on the Platform if needed.
4.6 Keep your password and account details secure.
4.7 If we suspect misuse, we may ask you to change your password.
4.8 Your personal information is handled according to our Privacy Policy.
4.9 While we aim to keep things secure, we do not monitor all information shared through the Platform (except personal and payment data).
5. Inappropriate Content
5.1 We will try to remove accounts or content that break the rules or the law, once we’re notified.
5.2 If you believe something on the Platform is offensive or violates rights, contact us (see Section 16).
6. Intellectual Property
6.1 All content and features on the Platform belong to ProPlay Academy.
6.2 We reserve all rights to trademarks, copyrights, and other intellectual property.
6.3 You are not given any ownership rights. Do not alter or remove any notices or security features on the Platform.
6.4 Do not share or post content from the Platform in a way that breaks someone else’s rights.
6.5 “Playwithme” is a trademark of Game Gambit Ltd. Other game names belong to their original creators.
6.6 Do not use our trademark unless we give you written permission.
7. Accuracy and Availability
7.1 We try to keep the Platform accurate and up to date but cannot guarantee it.
7.2 We may suspend or stop the Platform at any time.
7.3 The content is for general information only and not professional advice.
7.4 We cannot guarantee constant availability or uninterrupted use.
8. Cancellation Policy
8.1 Services depend on availability. If an Order can’t be completed (e.g. due to legal reasons), we will cancel it and refund you.
9. Our Liability
9.1 If we breach this agreement, we are only responsible for losses that were foreseeable.
9.2 We are not responsible for losses that weren’t predictable or not caused by us.
9.3 We’re not liable for:
- Loss of profits
- Lost business
- Lost contracts
- Data loss or corruption
- Any indirect or special damage
9.4 Our total liability is limited to what you paid on the Platform.
9.5 We’re not liable for any damages beyond that limit.
9.6 Again, our total liability is capped at what you’ve paid us.
9.7 Nothing in this agreement limits our liability for fraud or anything the law doesn’t allow us to limit.
9.8 We’re not responsible for things outside our control.
10. Transferring Rights
10.1 Only you and we have rights under this agreement.
10.2 We can transfer our rights to another company. You will be informed, and your rights won’t change.
10.3 You cannot transfer your rights to someone else without our approval.
11. Changes to These Terms
11.1 We must agree in writing for any changes to this agreement.
11.2 We can update these terms from time to time. If you continue using the Platform, it means you accept the new terms.
12. Complaints
12.1 If you have any complaints, contact us (see Section 16). We’ll try to resolve things quickly and fairly.
13. Disclaimer
13.1 Some parts of the Platform (such as technical support) are provided “as-is” without guarantees.
13.2 We do not guarantee that the Platform will:
- Meet your needs
- Always work perfectly
- Be accurate, safe, or bug-free
13.3 We are not affiliated with any of the games or companies mentioned. Any content related to them remains the property of its original owner.
14. Governing Law
These terms are governed by the laws of England. Disputes will be handled under English law. If you’re in the EEA or Switzerland, you may use the EU online dispute platform: http://ec.europa.eu/consumers/odr
15. Dispute Resolution
If you have a dispute or issue, first contact our support team at support@proplay-academy.com. If it can’t be resolved, you can request escalation. Final decisions are made by our management. You may choose independent arbitration, and UK law applies.
